{"id":505,"date":"2012-03-12T21:15:13","date_gmt":"2012-03-12T20:15:13","guid":{"rendered":"http:\/\/www.evematringe.eu\/bl0g\/?p=505"},"modified":"2019-03-28T21:21:29","modified_gmt":"2019-03-28T20:21:29","slug":"reparation-de-labus-de-rupture-de-periode-dessai-cass-soc-11-janvier-2012-n10-14868","status":"publish","type":"post","link":"https:\/\/www.evematringe.eu\/bl0g\/2012\/03\/12\/reparation-de-labus-de-rupture-de-periode-dessai-cass-soc-11-janvier-2012-n10-14868\/","title":{"rendered":"R\u00e9paration de l\u2019abus de rupture de p\u00e9riode d\u2019essai: Cass. soc. 11 janvier 2012, n\u00b010-14868"},"content":{"rendered":"<header class=\"entry-header\"><\/header>\n<div class=\"entry-content\">\n<p align=\"justify\">Le l\u00e9gislateur indique \u00e0 l\u2019article L.1221-20 du Code du travail que \u00ab\u00a0<em>La p\u00e9riode d\u2019essai permet \u00e0 l\u2019employeur d\u2019\u00e9valuer les comp\u00e9tences du salari\u00e9 dans son travail, notamment au regard de son exp\u00e9rience, et au salari\u00e9 d\u2019appr\u00e9cier si les fonctions occup\u00e9es lui conviennent<\/em>\u00ab\u00a0.\u00a0Pendant cette p\u00e9riode, l\u2019employeur et le salari\u00e9 peuvent rompre unilat\u00e9ralement et discr\u00e9tionnairement le contrat, c\u2019est-\u00e0-dire que la rupture n\u2019a pas \u00e0 \u00eatre motiv\u00e9e et n\u2019est pas soumise aux r\u00e8gles qui encadrent le licenciement.<\/p>\n<div>\n<div>\n<div>\n<div>\n<p align=\"justify\">Depuis 2008, l\u2019article L.1221-19 du code du travail permet la stipulation d\u2019une p\u00e9riode d\u2019essai dont la dur\u00e9e maximale d\u00e9pend du statut du salari\u00e9, par exemple le maximum est de 4 mois lorsque le salari\u00e9 a le statut de cadre.\u00a0L\u2019article L.1221-21 du Code permet de renouveler la p\u00e9riode d\u2019essai une fois.\u00a0Le renouvellement comme la rupture de la p\u00e9riode d\u2019essai doivent respecter un d\u00e9lai de pr\u00e9venance depuis la loi du 25 juin 2008. L\u2019article L.1221-25 du Code du travail pr\u00e9voit ainsi la dur\u00e9e minimale du d\u00e9lai de pr\u00e9venance que doit respecter l\u2019employeur en cas de rupture en p\u00e9riode d\u2019essai d\u2019un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e. La dur\u00e9e du d\u00e9lai augmente, en fonction de la dur\u00e9e de pr\u00e9sence du salari\u00e9 dans l\u2019entreprise (autrement dit, de son anciennet\u00e9).<\/p>\n<p align=\"justify\">Cependant, la jurisprudence de la Cour de cassation encadre ce droit afin d\u2019\u00e9viter les abus qui ne manquent pas de se produire. La Cour de cassation v\u00e9rifie que la rupture du contrat est fond\u00e9e exclusivement sur une appr\u00e9ciation des comp\u00e9tences professionnelles du salari\u00e9. L\u2019appr\u00e9ciation des juges du fond est souveraine.
